Terms of Service — Rikai Sensei

1. Acceptance of Terms

By creating an account or using the Rikai Sensei mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Dave Vucko, doing business as Rikai Sensei (“Rikai Sensei,” “we,” “us,” or “our”), a sole proprietorship based in British Columbia, Canada.

2. Description of Service

Rikai Sensei is an educational language learning application that teaches Japanese vocabulary, grammar, and communication skills, including medical terminology for clinical communication contexts.

2.1 What the App IS

  • An educational language learning tool
  • A supplement to professional language training
  • A study aid for JLPT (Japanese Language Proficiency Test) preparation
  • A vocabulary and grammar reference for healthcare communication contexts

2.2 What the App IS NOT

  • A medical device, diagnostic tool, or clinical reference
  • A substitute for professional medical training or certification
  • A replacement for certified medical interpreters in clinical settings
  • A guarantee of language proficiency or medical competency

2.3 AI-Assisted Content

Some of the App’s learning content — including example sentences, glosses, explanations, and translations — is produced with the assistance of artificial-intelligence tools and reviewed by humans before publication. While we work to ensure accuracy, AI-assisted content may contain errors, and it is provided on the “as is” basis described in Section 7. This is especially important for medical terminology; see Section 3 and our Medical Disclaimer.

3. EDUCATIONAL DISCLAIMER — MEDICAL CONTENT

IMPORTANT — PLEASE READ CAREFULLY

Rikai Sensei teaches medical Japanese vocabulary and grammar for educational purposes only. The medical terminology, clinical communication patterns, and healthcare-related content in this App:

(a) Do NOT constitute medical advice, clinical guidance, or professional medical training;

(b) Do NOT replace professional medical interpretation services, clinical training programs, or medical certification requirements;

(c) Must NOT be relied upon as the sole source of medical terminology in clinical settings — healthcare providers must use certified medical interpreters for patient care and clinical decision-making;

(d) Are provided “as is” without warranty of accuracy, completeness, or fitness for any particular clinical purpose;

(e) Are intended to supplement, not replace, formal language education and professional development.

By using this App, you acknowledge and agree that you will not hold Rikai Sensei liable for any consequences arising from the application of content learned through this App in clinical or professional settings.

4. User Accounts

4.1 Account Creation

To use the App, you create an account by signing in with a supported third-party provider (Google, Apple, Discord, or Facebook). We do not offer password-based sign-up; authentication is handled by your chosen provider. You are responsible for:

  • Maintaining the security of the provider account you use to sign in
  • All activity under your account

4.2 Account Deletion

You may delete your account at any time from within the App via Profile > Account Management > Delete Account. Upon deletion:

  • Your account is deactivated immediately, followed by a 30-day grace period during which you can recover it by signing back in
  • All personal data is permanently deleted after the grace period
  • Active subscriptions must be cancelled separately through your device’s App Store or Google Play settings
  • Subscription transaction records (anonymized) may be retained for up to 7 years for tax compliance

4.3 Account Termination

We reserve the right to suspend or terminate your account if you:

  • Violate these Terms
  • Use the App for unlawful purposes
  • Attempt to reverse engineer, decompile, or extract the App’s source code
  • Redistribute, resell, or sublicense App content without authorization

5. Subscription Terms

5.1 Free Tier

The App offers a free tier with limited access to content (foundational lessons and core features). No payment is required for the free tier.

5.2 Paid Subscriptions

Additional content and features are available through auto-renewing paid subscriptions (currently offered as Plus and Premium tiers). Subscription options, prices, and any free-trial terms are shown in the App and on the App Store or Google Play at the time of purchase, in your local currency. Apple or Google processes all payments.

5.3 Auto-Renewal

Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. Your payment method will be charged at the start of each new billing period.

5.4 Cancellation

You may cancel your subscription at any time through your device’s subscription settings:

  • iOS: Settings > (your name at the top) > Subscriptions > Rikai Sensei > Cancel Subscription
  • Android: Google Play Store > Menu > Subscriptions > Rikai Sensei > Cancel

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until the period ends.

5.5 Refunds

Refunds are handled by Apple (App Store) or Google (Play Store) in accordance with their respective refund policies. Rikai Sensei does not process refunds directly. For refund requests, contact Apple or Google support through your device’s app store.

5.6 Price Changes

We may change subscription prices with at least 30 days’ advance notice. Existing subscribers will be notified before any price change takes effect and may cancel before the new price applies.

6. Intellectual Property

6.1 Our Content

All content in the App — including but not limited to lessons, vocabulary data, grammar explanations, audio recordings, illustrations, UI design, and software code — is owned by or licensed to Rikai Sensei and protected by copyright and other intellectual property laws.

6.2 Your License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial educational purposes, subject to these Terms.

6.3 Restrictions

You may not:

  • Copy, modify, or distribute App content
  • Reverse engineer, decompile, or disassemble the App
  • Use the App to create competing products or services
  • Scrape, crawl, or extract data from the App
  • Share your account credentials with others
  • Use the App for any commercial purpose (e.g., reselling content, conducting paid tutoring sessions using App content) without written permission

6.4 Your Content

If you create content within the App (e.g., custom mnemonics, notes), you retain ownership of your input. You grant Rikai Sensei a non-exclusive, royalty-free license to store and display your content within the App as necessary to provide the service.

7. Limitation of Liability

7.1 Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure
  • Content (including AI-assisted content) will be accurate, complete, or current
  • The App will meet your specific learning objectives
  • Medical terminology taught will be appropriate for every clinical context

7.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RIKAI SENSEI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:

  • Your use of or inability to use the App
  • Any errors, inaccuracies, or omissions in App content
  • The application of content learned through the App in clinical or professional settings
  • Unauthorized access to your account or data
  • Any third-party conduct or content

7.3 Maximum Liability

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED CANADIAN DOLLARS ($100 CAD), WHICHEVER IS GREATER.

7.4 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

8. Indemnification

You agree to indemnify and hold harmless Rikai Sensei, including its owner and any agents, from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your misuse of App content in clinical or professional settings
  • Your violation of any applicable law or regulation
  • Any claim by a third party related to your use of the App

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

10.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved as follows:

  1. Informal Resolution: You and Rikai Sensei will first attempt to resolve the dispute informally by contacting rikaisenseiapp@gmail.com. We will attempt to resolve the matter within 30 days.

  2. Mediation: If informal resolution fails, the dispute shall be submitted to mediation administered by the British Columbia Mediator Roster Society or a mutually agreed mediator.

  3. Litigation: If mediation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of British Columbia, Canada.

10.3 Class Action Waiver

To the extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class, consolidated, or representative action.

11. General Provisions

11.1 Entire Agreement

These Terms, together with the Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and Rikai Sensei regarding the App.

11.2 Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

11.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

11.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without your consent.

11.5 Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via in-app notification at least 30 days before taking effect. Continued use of the App after changes constitutes acceptance.
